These Terms and Conditions apply to purchases made through the Happy Tortoise Habitat website.

Please read them carefully before placing an order. By placing an order through our website, you agree to these Terms and Conditions.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

We sell handmade tortoise tables, outdoor runs, accessories, tortoise equipment and live tortoises.

2. Using Our Website

You may use our website for lawful purposes and to browse or purchase the products we offer.

We make reasonable efforts to ensure that information displayed on the website is accurate and up to date. If we discover an error affecting an order, such as an incorrect price, product description or availability, we will contact you as soon as reasonably possible.

3. Product Information

We make reasonable efforts to describe and photograph our products accurately.

Because some of our products are handmade, minor variations in appearance, finish, colour, dimensions or materials may occur where these do not materially affect the product.

Photographs displayed on screens may also vary slightly in colour depending on the device and display settings being used.

Any dimensions provided should be checked before ordering, particularly when purchasing a tortoise table, outdoor run or other large item.

4. Handmade and Made-to-Order Products

Many Happy Tortoise Habitat products are handmade.

Where a product is made after an order is placed, the product page may provide an estimated production or dispatch time.

Estimated production and delivery times are provided in good faith but may occasionally be affected by circumstances outside our reasonable control.

If a significant delay occurs, we will contact you where reasonably possible.

5. Bespoke and Personalised Products

Some products may be made to an individual customer’s specifications.

Where a product is genuinely personalised or made to specifications supplied by you, the normal statutory right to cancel a distance contract may not apply.

Selecting standard options that we routinely offer does not necessarily mean that a product is legally considered bespoke or personalised.

Where an item will be treated as a bespoke or personalised product, this should be made clear before the order is completed.

Your statutory rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods are not affected.

6. Prices

Prices displayed on the website are shown in pounds sterling (£) unless otherwise stated.

The price payable will be the price shown when you place your order, together with any applicable delivery charges and optional extras selected by you.

Delivery charges, where applicable, will be displayed or calculated during the ordering process.

If we discover an obvious pricing error after you place an order, we will contact you before fulfilling the affected order.

7. Placing an Order

Adding an item to your basket does not reserve it.

Before completing checkout, you are responsible for checking that:

  • you have selected the correct product
  • any product options are correct
  • quantities are correct
  • your billing and delivery information is accurate
  • your contact information is accurate

After placing an order, you should receive an order confirmation electronically.

We reserve the right to decline or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable
  • payment cannot be authorised
  • an obvious pricing or product-information error has occurred
  • delivery cannot reasonably be made to the address supplied
  • fulfilling the order would breach a legal or regulatory requirement

If we cancel an order after payment has been taken, the relevant amount will be refunded.

8. Payment

Available payment methods are displayed during checkout.

Payments may be processed by third-party payment providers such as PayPal.

Your use of a payment provider may also be subject to that provider’s terms and conditions.

An order is not considered paid until the relevant payment has been successfully authorised or received.

9. Delivery

We deliver products to locations supported by the delivery options available through our website.

Delivery charges and available methods may depend on the product, size, weight and destination.

Please ensure that the delivery address supplied with your order is complete and accurate.

For larger products, you should also ensure that there is reasonable access for delivery.

Where a delivery timeframe is stated, we will make reasonable efforts to meet it. Handmade or made-to-order products may require additional production time before dispatch.

Unless a different delivery timeframe has been agreed, goods will be delivered within the period required by applicable consumer law.

10. International Orders

Some non-animal products may be available for delivery outside the United Kingdom.

International availability, delivery charges and restrictions depend on the destination and product.

Customers ordering internationally may be responsible for customs duties, import taxes or other charges imposed in the destination country where applicable.

Please contact us before ordering if you are unsure whether we can deliver a particular product to your country.

Live tortoises are not available for international delivery through our normal website ordering process.

11. Live Tortoises

Additional conditions apply when purchasing a live tortoise.

We take the health and welfare of animals offered for sale seriously.

Tortoises are offered for sale only when considered healthy and suitable for sale.

Information provided about an individual tortoise, including species, age, microchipping and documentation, should be read carefully before ordering.

Where relevant, tortoises are supplied with the appropriate documentation associated with the animal.

Customers purchasing a tortoise are responsible for ensuring that they have appropriate accommodation, heating, UVB lighting, diet and other equipment necessary for the species being purchased.

If you are unsure whether a particular tortoise is suitable for you, please contact us before ordering.

12. Live Animal Delivery

Live tortoises are delivered using a specialist reptile courier experienced in transporting live animals.

Live-animal delivery is therefore different from ordinary parcel delivery and may only be available on particular days or to particular locations.

Delivery arrangements will depend upon the specialist courier service available at the time.

Someone responsible must be available to receive the animal at the agreed delivery address.

Please ensure that your telephone number and delivery information are accurate so that delivery arrangements can be made where necessary.

13. Cancelling an Order for Ordinary Goods

For most goods purchased online, consumers have a statutory right to change their mind.

You normally have 14 days after receiving your goods to tell us that you wish to cancel your order.

You do not need to give a reason.

After notifying us of your cancellation, you normally have a further 14 days to return the goods.

Please provide your name, order number and details of the item you wish to return.

Certain statutory exceptions apply, including some genuinely personalised or custom-made products and certain other categories of goods.

14. Returning Ordinary Goods After Cancellation

Unless we agree otherwise, you are responsible for returning cancelled goods to us.

Goods should be returned appropriately packaged and protected from damage.

You are responsible for the direct cost of returning unwanted goods unless:

  • we have agreed to pay the return cost
  • the goods are faulty or incorrect and the law requires us to bear the appropriate return cost
  • another arrangement has been agreed with us

For particularly large items that cannot normally be returned through an ordinary postal service, please contact us before arranging the return.

You may be responsible for any reduction in the value of goods caused by handling them beyond what would reasonably be necessary to establish their nature, characteristics and functioning.

15. Refunds for Cancelled Orders

Where you exercise a statutory right to cancel an eligible online purchase, we will provide the refund required by law.

This will normally include the price paid for the returned goods and the cost of our least expensive standard delivery option where the original delivery charge is required to be refunded.

If you chose a more expensive delivery service, we do not have to refund the additional amount above our standard delivery charge.

Refunds will normally be made using the original payment method.

For returned goods, we may withhold the refund until we have received the goods back or you provide evidence that they have been returned, where the law allows us to do so.

Refunds will be made within the timescale required by applicable consumer law.

16. Faulty, Damaged or Incorrect Goods

Please contact us as soon as possible if your order:

  • arrives damaged
  • is faulty
  • is not as described
  • is not fit for its intended purpose
  • contains an incorrect item

Consumer goods must meet the standards required by UK consumer law. Your statutory rights cannot be removed by these Terms and Conditions.

Your rights concerning faulty goods are separate from the right to change your mind about eligible online purchases.

17. Cancellations, Returns and Health Concerns for Live Tortoises

Because live animals have particular welfare and transport requirements, please contact us as soon as possible if you need to cancel an order for a tortoise.

If the animal has already been booked with or collected by the specialist reptile courier, contact us immediately rather than attempting to return or transport the animal yourself.

If you have any concern about the health or condition of a tortoise following delivery, please contact us promptly so that the circumstances can be assessed and appropriate action discussed.

Do not return a live tortoise through an ordinary postal or parcel delivery service.

The welfare of the animal must be considered when making any return or transport arrangements.

Nothing in this section excludes or restricts any statutory rights that apply to your purchase.

18. Care of Live Tortoises

Purchasing a tortoise involves a long-term responsibility.

The customer is responsible for providing appropriate ongoing care after purchase, including suitable:

  • accommodation
  • temperature and heating
  • UVB lighting
  • diet
  • hydration
  • hygiene
  • environmental conditions
  • veterinary care where necessary

Requirements vary between species.

Appropriate care information should be followed, and customers should seek advice before purchase if they are uncertain about the requirements of the animal.

19. Customer Accounts

You may be able to create an account on our website to view and manage information relating to your orders.

You are responsible for keeping your account login information confidential and for notifying us if you believe your account has been accessed without authorisation.

Personal information provided through the website is handled in accordance with our Privacy Policy.

The Terms and Conditions applying to an order will normally be those in force when the order was placed.

These Terms and Conditions are governed by the laws applicable in England and Wales.

Consumers retain any rights concerning jurisdiction that cannot legally be excluded or restricted by these Terms and Conditions.
